Preliminary provisions
- Online shop available at www.masazebalian Thai.pl is administered by
AYRAXIS COMPANY WITH LIMITED LIABILITY with its registered office in Warsaw, Aleja John Paul II 27, 00-867 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register under the number KRS 0001219273, NIP 5273201527, REGON 543802242, hereinafter referred to as "Seller". - These Terms and Conditions specify the terms of use of the Shop and the rules for the conclusion of distance sales contracts.
- The regulations are addressed to Consumers and Entrepreneurs using the Store.
§ 2
Definitions
- Consumer – a natural person carrying out a legal act not directly related to his or her business or profession.
- Entrepreneur – an entity performing an economic activity in its own name.
- Client – any entity purchasing at the Store.
- Seller AYRAXIS COMPANY WITH LIMITED RESPONSIBILITY.
- Shop – online shop available at www.masazebalian Thai.pl.
- Product – voucher entitled to use massage services offered by the Seller.
- Voucher – a document (electronic or paper) confirming the right to use the service.
- Sales Agreement – the contract concluded between the Client and the Seller through the Store.
- Order – a statement of the Customer's will to conclude the Sales Agreement.

§ 4
Technical requirements
In order to use the Shop, including browsing the assortment of the Shop and placing orders for Products, you need:

General
- The prices given in the Store are expressed in PLN (PLN) and are gross prices.
- Viewing the Store offer does not require registration.
- The seller shall not be liable for disturbances resulting from force majeure or from actions of third parties.

Procurement rules
In order to submit the Contract, it is appropriate to:
- Select the Voucher and add it to the Basket.
- Complete the Order Form with the required data.
- Choose payment method.
- Click the "I order and pay" button.
Choose one of the available payment methods and depending on the method of payment, pay the order within the specified time limit

Offered delivery methods and payments
- Voucher as Product is supplied in electronic form (PDF file) to the e-mail address indicated by the Customer when submitting the Order.
- The electronic voucher shall be sent after the payment has been recorded.
- If the Customer wishes to receive a paper version of Voucher, he is obliged to contact the Seller after the purchase, in order to determine the details of the shipment.
- The paper version of the voucher is sent after prior agreement of terms with the Seller.
- Delivery is carried out in the Republic of Poland.
- The prices of products in the Shop are given in Polish zlotys, they include tax without shipping costs. Shipping costs are added to the sum of the products ordered and are borne by the Customer. The final price of the Owner and Client is the price of the product given in the offer at the time of placing the order by the Client.
Types and prices of deliveries:
(a) INPOST: 16 PLN / delivery time 1-4 working days
(b) DPD: 16 PLN / delivery time 1-4 working days
(c) personal reception in AYU BALIAN MASSES: free
Prices and payment methods
The customer may make a payment by:

- payment in eService system
- payment by payment card: VISA, MasterCard.

§ 9
Implementation of the sales contract
- Conclusion of the Sales Agreement occurs when the Customer receives an e-mail confirming acceptance of the Order for execution.
- In the absence of payment within 1 day The order can be cancelled.
Delivery of the Product is carried out only in Poland.
§ 10
Right of withdrawal
- The consumer has the right to withdraw from the distance contract within 14 days without giving a reason.
- Please send your resignation statement to your e-mail address Vendors or post office address.
- In the event of effective withdrawal, the contract shall be deemed not to have been concluded.
- The seller shall reimburse all payments received no later than 14 days after receipt of the declaration.
- The goods returned by the Customer may not be used in any massage parlor AYU BALIAN MASASSES
§ 11
Complaint and guarantee
The Sales Agreement includes new Products.
In the event of a defect purchased from the Seller, the Customer has the right to complain based on the provisions of the Consumer Rights Act (Journal of Laws of 2020 item 287).
Complaints shall be made in writing or by electronic means at the addresses of the Seller specified in these Terms and Conditions.
The seller shall respond to the complaint without delay, no later than 14 days, and if he does not do so within that time limit, the Customer's request shall be deemed justified.
Goods returned under the complaint procedure must be sent to the address given in paragraph 3 of these Rules.
§ 12
Out-of-court means of handling complaints and redress
Detailed information on the possibility for the Consumer to take advantage of out-of-court means of handling complaints and redress and the rules for access to these procedures are available at the premises and on the websites of district (urban) consumer spokespersons, social organisations whose statutory tasks include consumer protection, Regional Trade Inspectorates and at the following Internet addresses of the Office for Competition and Consumer Protection: http://www.uokik.gov.pl/spory_consumer.php; http://www.uokik.gov.pl/cases_individual.php and http://www.uokik.gov.pl/wagne_addressy.php.
The consumer has the following examples of possibilities to use out-of-court means of handling complaints and redress:
The consumer is entitled to appeal to the permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on the Commercial Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle the dispute arising from the Agreement concluded with the Seller.
The consumer is entitled to address the Provincial Inspector of the Commercial Inspection, in accordance with Article 36 of the Act of 15 December 2000 on the Commercial Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings on the amicable conclusion of the dispute between the Consumer and the Seller.
The consumer may receive free assistance in resolving the dispute between him and the Seller, also using the free state aid of the (urban) consumer spokesperson or social organisation, whose statutory tasks include consumer protection (e.g. Consumer Federation, Polish Consumer Association).
§ 13
Personal data in the Online Store
The administrator of personal data of Clients collected through the Online Store is the Seller.
Personal data of Clients collected by the administrator through the Online Store are collected for the purpose of implementing the Sales Agreement, and if the Customer agrees to this, also for marketing purposes.
The recipients of personal data of Online Shop Clients may be:
In the case of the Client who uses the method of delivery by post or courier in the Online Store, The administrator shall make the collected personal data available to the selected carrier or intermediary carrying out the shipment on behalf of the Administrator.
In the case of a Client who uses the electronic payment method or payment card in the Online Store, the Administrator shall provide the collected personal data to the Client, the selected entity serving the above payments in the Online Store.
4. The customer has the right to access and improve the content of his data.
5. The provision of personal data is voluntary, although the personal data required for the conclusion of the Agreement are not provided in the Rules of Procedure. Sales result in the inability to conclude this contract.
§ 14
Final provisions
1. Agreements concluded through the Online Store are concluded in Polish.
2. The Seller reserves the right to make changes to the Rules of Procedure for important reasons, i.e. changes to the laws, changes to payment and delivery methods, insofar as these changes affect the implementation of the provisions of these Rules. Each change, the Seller shall inform the Customer at least 7 days in advance.
3. In cases not governed by these Regulations, the general provisions of Polish law apply, in particular: Civil Code; Electronic Services Act; Consumer Rights Act, Personal Data Protection Act.
4. The customer has the right to use out-of-court means of handling complaints and claims. For this purpose, it may lodge a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
