Preliminary provisions

2. These Regulations are addressed to the Consumers and specify the rules and mode of concluding a distance sales agreement with the Consumer through the Shop.

§ 2

Definitions

Consumer – a natural person concluding a contract with the Seller within the Store, the object of which is not directly related to its business or professional activity.

Client – any entity making purchases through the Store.

An entrepreneur – a natural person, a legal person and an organisational unit not a legal person, whose separate act confers legal capacity, carrying out in its own name an economic activity which uses the Store.

Shop – online shop run by the Seller at www.masazebalian Thai.pl

Distance contract – a contract concluded with the Client in the framework of an organized system of conclusion of distance contracts (under the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication until the conclusion of the contract.

Regulations – these regulations of the Shop.

Order – a statement of the Customer's will made using the Order Form and aimed directly at concluding the Sales Agreement of the Product or Products with the Seller.

Account – the customer account in the Store, the data provided by the Client and information about the Orders submitted by him in the Store are collected in it.

Registration form – a form available in the Store, allowing the creation of an Account.

Order form – interactive form available in the Shop, allowing to submit the Order, in particular by adding the Products to the Cart and defining the terms of the Sales Agreement, including the delivery and payment method.

Basket – the software element of the Shop, in which the products are visible to the Customer for purchase, as well as the possibility of determining and modifying the Order data, in particular the quantity of products.

Product – available in the Store moving item/service subject to the Sales Agreement between the Client and the Seller.

Sales contract – Product sale contract concluded or concluded between the Client and the Seller via the Online Store. The Sales Agreement shall also mean – application to the characteristics of the Product – a service contract and a work contract.

§ 3

§ 4

Technical requirements

In order to use the Shop, including browsing the assortment of the Shop and placing orders for Products, you need:

§ 5

General

The seller in the widest extent permitted by law shall not be liable for interruptions in the operation of the Store due to force majeure, unauthorised action of third parties or incompatibility of the Online Store with the client's technical infrastructure.

Viewing the Store range does not require an Account. It is possible for the Customer to place orders for Products in the assortment of the Shop either after the Account has been established in accordance with the provisions of § 6 of the Rules of Procedure or by providing the necessary personal and address data to enable execution of the Order without establishing the Account.

The prices given in the Shop are given in Polish zlotys and are gross prices (including VAT).

The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including transport, delivery and postal services), of which the Customer is informed on the Store's pages during the submission of the Order, including when expressing his will to be bound by the Sales Agreement.

If the nature of the subject matter of the Agreement does not permit, reasonably assessing, prior calculation of the final (final) price, the information on how the price will be calculated, as well as the charges for transport, delivery, postal services and other costs, will be given in the Shop in the Product description.

§ 6

Procurement rules

d. log in or use the possibility of submitting an Order without registration;
e. if you have chosen to submit an Order without registration – fill in the Order Form by entering the data of the recipient of the Order and the address to which the Product is to be delivered, choose the type of shipment (the method of delivery of the Product), enter the data in the invoice if different from the data of the recipient of the Order,

g. Choose one of the available payment methods and depending on the method of payment, pay the order within a specified period

§ 8

Offered delivery methods and payments

The Customer may use the following methods of delivery or reception of the ordered Product:

Shipping, InPost parcels, electronic ticket

  1. The prices of products in the Shop are given in Polish zlotys, they include tax without shipping costs. Shipping costs are added to the sum of the products ordered and are borne by the Customer. The final price of the Owner and Client is the price of the product given in the offer at the time of placing the order by the Client.
    Types and prices of deliveries:
    (a) INPOST: 16 PLN / delivery time 1-4 working days
    (b) DPD: 16 PLN / delivery time 1-4 working days
    (c) personal reception in AYU BALIAN MASASSES
  2. Information on the total value of the order (including the delivery costs detailed in the Delivery and Returns tab) shall be made available in the Summary of the Order on the sales page of the product and in the order confirmation.
  3. The delivery of Vouchers takes place in the area of the Republic of Poland.
  4. Delivery of ordered Goods is carried out by courier, parcel, electronically via e-mail, and personal reception
  5. The delivery date for deliveries in the territory of the Republic of Poland is 1-7 working days calculated from the date of payment of the Order by the Customer.
  6. The customer, along with the consignment, will be given a printout of the confirmation and specifications of the Order and proof of sale. VAT invoice may be issued at the express request of the Client.

Prices and payment methods

Prices of Goods are given in Polish zlotys and contain all components, including VAT. The customer can pay the price:

§ 9

Implementation of the sales contract

Conclusion of the Sales Agreement between the Customer and the Seller is made after the Customer has previously placed the Order using the Order Form in the Online Store in accordance with § 7 of the Rules of Procedure.

After submitting the Order, the Seller immediately confirms receipt and accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is made by sending the Seller an appropriate e-mail to the given during submission Orders the e-mail address of the Client, which contains at least the Seller's statements about receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. On receipt of the above e-mail by the Customer, the Sales Agreement between the Customer and the Seller is concluded.

If selected by the Client:

transfers, electronic payments or card payments, The customer is obliged to make payment within the time limit 3 calendar days from the date of conclusion of the Sales Agreement, otherwise the order will be cancelled.

The product will be sent by the Seller within the time limit specified in its description (subject to paragraph 5 of this paragraph), in a manner chosen by the Customer when submitting the Order.

In the case of procurement of Products with different delivery dates, the delivery date shall be the longest given date.

The beginning of the delivery date of the Product to the Customer shall be as follows:

If the Customer chooses to pay by bank transfer, electronic payment or card – from the date of recognition of the Seller's bank account.

Delivery of the Product is carried out only in Poland.

§ 10

Right of withdrawal

Customers of online shops have the right to withdrawal. The seller shall bear the cost of returning the goods in the amount of 16zł.

  1. The customer, who is a consumer within the meaning of Article 22 of the Civil Code, is entitled, by law, to withdraw from a distance contract, without giving a reason, by making a written or e-mail statement to voucher@masazebalian Tajski.pl, within the time limit 14 days and sending them to SELLING Trade/Poland Limited Liability Company
  2. In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded.
  3. The goods returned by the Customer may not be used in any massage parlor AYU BALIAN MASASSES
  4. In the event of withdrawal from this agreement, the store will refund to the Customer all payments received from it, including the costs of delivery of the goods (except for additional costs resulting from the method chosen by the Customer of delivery other than the cheapest way of delivery offered by the Shop), immediately, no later than 14 days from the date on which the goods were returned. The refund will be made using the same payment methods as used by the Customer in the original transaction, unless the parties agree otherwise.

§ 11

Complaint and guarantee

The Sales Agreement includes new Products.

In the event of a defect purchased from the Seller, the Customer has the right to complain based on the provisions of the Consumer Rights Act (Journal of Laws of 2020 item 287).

Complaints shall be made in writing or by electronic means at the addresses of the Seller specified in these Terms and Conditions.

The seller shall respond to the complaint without delay, no later than 14 days, and if he does not do so within that time limit, the Customer's request shall be deemed justified.

Goods returned under the complaint procedure must be sent to the address given in paragraph 3 of these Rules.

§ 12

Out-of-court means of handling complaints and redress

Detailed information on the possibility for the Consumer to take advantage of out-of-court means of handling complaints and redress and the rules for access to these procedures are available at the premises and on the websites of district (urban) consumer spokespersons, social organisations whose statutory tasks include consumer protection, Regional Trade Inspectorates and at the following Internet addresses of the Office for Competition and Consumer Protection: http://www.uokik.gov.pl/spory_consumer.php; http://www.uokik.gov.pl/cases_individual.php and http://www.uokik.gov.pl/wagne_addressy.php.

The consumer has the following examples of possibilities to use out-of-court means of handling complaints and redress:

The consumer is entitled to appeal to the permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on the Commercial Inspection (Journal of Laws of 2014, item 148, as amended), with a request to settle the dispute arising from the Agreement concluded with the Seller.

The consumer is entitled to address the Provincial Inspector of the Commercial Inspection, in accordance with Article 36 of the Act of 15 December 2000 on the Commercial Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings on the amicable conclusion of the dispute between the Consumer and the Seller.

The consumer may receive free assistance in resolving the dispute between him and the Seller, also using the free state aid of the (urban) consumer spokesperson or social organisation, whose statutory tasks include consumer protection (e.g. Consumer Federation, Polish Consumer Association).

§ 13

Personal data in the Online Store

The administrator of personal data of Clients collected through the Online Store is the Seller.

Personal data of Clients collected by the administrator through the Online Store are collected for the purpose of implementing the Sales Agreement, and if the Customer agrees to this, also for marketing purposes.

The recipients of personal data of Online Shop Clients may be:

In the case of the Client who uses the method of delivery by post or courier in the Online Store, The administrator shall make the collected personal data available to the selected carrier or intermediary carrying out the shipment on behalf of the Administrator.

In the case of a Client who uses the electronic payment method or payment card in the Online Store, the Administrator shall provide the collected personal data to the Client, the selected entity serving the above payments in the Online Store.

4. The customer has the right to access and improve the content of his data.

5. The provision of personal data is voluntary, although the personal data required for the conclusion of the Agreement are not provided in the Rules of Procedure. Sales result in the inability to conclude this contract.

§ 14

Final provisions

1. Agreements concluded through the Online Store are concluded in Polish.

2. The Seller reserves the right to make changes to the Rules of Procedure for important reasons, i.e. changes to the laws, changes to payment and delivery methods, insofar as these changes affect the implementation of the provisions of these Rules. Each change, the Seller shall inform the Customer at least 7 days in advance.

3. In cases not governed by these Regulations, the general provisions of Polish law apply, in particular: Civil Code; Electronic Services Act; Consumer Rights Act, Personal Data Protection Act.

4. The customer has the right to use out-of-court means of handling complaints and claims. For this purpose, it may lodge a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
